Nota:Prices tagged on the website are duty free.Due to our geographic location we are unable to give you a price quote including VAT therefore you will have to add all duties taxes due in your respective countries upon receipt of the goods.
Prices given in other currency than EUROS on www.koakai.biz are just an estimate due to the fluctuating exchange rates of the currencies at the moment.
 
1)ARTICLE 1
SALES and TERMS
 
The following sales terms are applicable to all ordres placed on www.koakai.biz
KOAKAI has the rights to modify at anytime the fore mentionned sales terms.In case of a change of terms the general terms of sales will be applied to each orders.
 
2)ARTICLE 2
PRODUCTS AVAILABILITY
 
Upon receipt of your order we will check right away on availablity of products ordered.In case of non availablity we will within 30 days of original order confirmation either send you the product ordered,a similar product at equivalent price or send you back a check for the value of the order or give you a credit for a further order.
We are only advertising and putting online products that are either in stock in house or at our suppliers
Validation of order starts:
On date of order with payment validation by C/C online
Receipt of check in case of check payment
Value date of wire transfer on our account in case of such a payment
 
In case of an exceptionnal non availabilty of a certain product on your order we will upon your approval send you the remainder of your order.

2)validation of your delivery address and your contact
3)Recap of order and final validation
4)Payment approval as selected on your order form
 
Order will be processed when those 4 steps will be successfully filled out

Koakai may at anytime and at his discretion modify its pricing policy but will apply prices as shown on date of order upon availability of the product on order date
 
5)PAYMENT and SECURITY POLICY

By CREDIT CARD
Payment will be made by a SECURED SYSTEM.NO PRIVATE BANKING INFORMATIONS will be seen on koakai.biz website.Therefore the C/C payment is fully secured and your order will be processed and validated upon approval of payment.
 
By CHECK(personal and bank).Made to KOAKAI.Only for customers from FRANCE and FRENCH OVERSEAS TERRITORIES
Your order will be put aside for 10 days.After that time without receipt of check your order will be cancelled.The order will be processed only upon receipt of the check.
 
SECURITY SYSTEM(SSL)
Your CREDIT CARD information are encoded thanks to the SSL SYSTEM(SECURE SOCKET LAYER)et will not appear on KOAKAI s website.We will not keep any records after any transaction.Therefore on every new order they ll be asked again(C/C informations).
 
PROPERTY of GOODS
The goods will remain KOAKAI s property until full payment of the order.Once products are shipped however they become the customer s property.
 
PAYMENT DEFAULT
KOAKAI will refuse any order from customer with past due payments(totally or partially)or with whom there is a litigation under way.
 
FRAUD CONTROL
KOAKAI in collaboration with FIA-NET will control all orders validated on its WEBSITE.These controls will protect KOAKAI from any fraudulent activities.In order to proceed to the FRAUD CONTROL we might have to resort to ask you(customer)all necessary documents to proceed on with your order(domiciliation;banking infos under your name,etc..)
These documents will be made electronically and by mail with proof of delivery.They ll be treated from the order sheet under the responsability of FIA-NET.
This secured system will analyze all transactions and will help against CREDIT CARD FRAUD.FIA-NET and the merchant from which you are purchasing your goods are the sole recipients of your order informations.The non transmission of your private informations given on you order form will void any fraudulent activity.In case of a fraudulent C/C activity the transaction will be kept and treated in PAYMENT FRAUD by FIA-NET.
A non approved and irregular act will also generate a specific treatment according to the LIBERTY and ELECTRONIC ACT dated from JAN.6th 1978 you will at any given moment have the right to oppose,rectify and have access to your personal informations in writing to FIA-NET-Service informatique et libertes-22 rue DROUOT-75009-PARIS-FRANCE

DELIVERY and TERMS CONDITIONS
 
For a delivery in FRANCE(METROPOLIS)
 
GENERAL CONDITIONS
Products will be delivered at the address given upon order process.All shipments will be insured at products value invoiced.
We are asking customer to verify systematically at receipt of goods the good and proper conditions of products.You will however have a 24 hours window to notify us of any damage.Beware that in case of any damage you will be asked to keep the original packaging in which products were sent.
For a matter of non possibity of a follow up we won t be able to deliver in any ARMY or MILITARY BASES outside of FRANCE(METROPOLIS)
We are declining all responsabilities in case of non delivery due to natural disasters,strikes,etc..
 
SHIPPING COST
Will be invoiced automatically in your BASKET.
 
SHIPPING DELAY
All product will ship within 24 hours(orders placed before NOON-LOCAL TIME- from MONDAY to FRIDAY will ship the same day)upon availability.In any other cases availabilty will be given on product sheet.The overall delay given are in working days.They are average delays excluding transportation time to our warehouse and treatment of order by our suppliers.
 
DELIVERY DELAY
The ordered products is delivered by existing POSTAL SYSTEM or by INDEPENDENT LOCAL TRANSPORTER..depending on nature of products and sizing and exclusively at KOAKAI s discretion..to the address on order s sheet.The delivery timing is given as an average time from our warehouse to you.The delivery system will depend on weight,sizing,value and volume of order.
TAKE NOTE THAT UPS does NOT DELIVER ON SATURDAY.
 
FROM PARCEL to DELIVERY
You will be asked to verify the conformity of the order/shipment upon delivery of goods and before signing the proof of delivery by assigned transporter.You will be asked in case of damaged or missing items or damaged and reboxed products to signify and sign a written assessment.This verification will be considered valid as either you(customer)or a person assignied by you will sign that proof of delivery form.
You will be asked also to send us by registered mail all problems or reserve you might have upon receipt of the order/shipment within 3 working days to the following address:

If products need to be re sent and returned to us you will be required an R/A(RETURN AUTHORIZATION#)from our CUSTOMER SERVICE DEPARTMENT within 7 days following delivery.All contest and protest will not be accepted past that delay.The returned products will be sent back to us in original packaging and conditions only.In case you are noticing a damage to package or box delivered in, you will be asked imperatively to check and control contents of and complete order and to notify right away to delivery/transporter company describing exactly and precisely extend of damage or loss.
We are asking that you make sure and double check your delivery address upon placing the order and to recap all details given.In case of a mistake by you(customer)you will be charged again for re shipping.
 
7)ARTICLE 7
RESPONSABILITIES

The professional(KOAKAI)is fully responsible toward its consumer(you) to the rightfull execution of the contract concluded between the 2 parties or with his suppliers.Without any prejudice to his rights toward its suppliers.
However the professional(KOAKAI)can be exonerated from all or partial responsability by proving the wrong doing or mistake from consumer(you)or a third party or in case of EXTREME EXTERNAL  CONDITION.
 
8)ARTICLE 8
RIGHT TO RETRACT
 
In conformity to ARTICLE-L.121-16 and following the CONSUMER CODE the consumer is given a 7 working days window following the delivery of products to return all products not fitting and ask for exchange or reimbursement without any charges except for return fee.The product shall be returned in good conditions,with all its accessories et non damaged.At best possible returned in its original packaging and non open.The return of goods could only be excercised by non copy type of goods such as DVD and BOOK and within allowed return time and its original packaging.
 
9)ARTICLE 9
RIGHT TO RETURN,EXCHANGE,CREDIT MEMO
 
You(customer)have a 7 days window starting at delivery date to return at your cost the package(partially or complete)see ARTICLE 8
In case of an exchange we reserve our rights to ask you for a participation of shipping cost to the new shipment.
Past that 7 days window we reserve our right to excercise at our discretion and to take back one or more product at invoiced cost or lesser cost.We will give you a CREDIT MEMO/NOTE.This MEMO shall be used within 4 months except if mentionned differently and in any case will not be reimbursed.
 
10)ARTICLE 10
WARRANTY and FOLLOW UP
 
The manufacturer warranty is in general a one year deal,product and labor,however and depending on the product it might be different and only part of the product might be exchanged.In order to fully beneficiate from MANUFACTURER s WARRANTY you MUST keep the ORIGINAL INVOICE.May we remind you that you have as well legal rights and in application of ARTICLES 1641-CIVIL RIGHTS- are protected against any hidden defects.
